Withdrawal of certain sections from Bill 2, An Act respecting family law reform with regard to filiation and amending the Civil Code in relation to personality rights and civil status

CONSIDERING THAT Bill 2 mandates that birth certificates would now include a gender marker added on demand as well as a “biological sex” marker, and considering that this identification would enable trans persons with genitals not corresponding to their gender identity to be immediately identifiable to anyone who acquires or sees their act of birth or birth certificate;
CONSIDERING THAT the bill attacks the right to integrity of trans persons by demanding surgical sex reassignment interventions and thus the mandatory sterilization of persons;
CONSIDERING THAT the bill attacks the right to integrity, dignity, equality and privacy of intersex people, who will be forced to use a gender identity designation that is assigned by their parents and will be forced to go through genital mutilation, sometimes without their consent, in order to have their “biological sex” marker amended;
CONSIDERING THAT the bill mandates that a child age fourteen or above may refuse their parent’s gender identity and that this will be reflected on their birth certificate, and that the designation “parent” would be limited to non-binary parents, forcing a coming-out when the certificate is presented;
We, the undersigned, ask that the Quebec government withdraw sections 23, 24, 26, 30, 33, 41, 42, 43, and 247 of Bill 2, deemed discriminatory for the entirety of trans, non-binary, and intersex people.
