Mme Lamarre : Bonjour. Alors,
ce point de presse vise à expliquer un peu plus en détail le projet de loi
n° 691, que je viens de déposer au salon bleu à l'Assemblée nationale, qui
est la Loi visant à interdire la facturation de frais accessoires pour des
services assurés, et le mot «pour des services assurés» est important. Alors,
ce que ça... Si on fait un bref rappel historique, dans le projet de loi
n° 20, que le ministre dit toujours qui a été très long, eh bien, le
ministre a introduit de façon tout à fait spontanée des amendements qui
visaient à autoriser des frais accessoires pour des frais d'équipement, des
frais de bureau, de cabinet et des tests diagnostiques.
Alors, c'est un précédent, c'est non
conforme à l'assurance médicale, au régime d'assurance médicale que nous avons
et c'est un précédent. Alors, il n'y avait jamais eu ce genre d'ouverture là.
Ce que le projet de loi vient dire, ce sont les services assurés, donc les
services médicaux, quand on va voir un ophtalmologiste, s'il nous charge
50 $, 100 $, 200 $ pour mettre des gouttes dans nos yeux, ce
n'est plus permis. Et donc, ça, c'est l'objet même du projet de loi. Pourquoi
ce n'est pas permis? Parce que ces frais-là, selon notre façon de voir les
choses, ils sont déjà inclus dans la rémunération, dans la masse salariale,
dans la masse de rémunération qui a été convenue pour les médecins, que ce soient
les médecins de famille ou les médecins spécialistes.
Alors, ces frais sont déjà inclus.
D'ailleurs, quand on regarde la liste, pour les spécialistes, des montants qui
leur sont attribués pour la rémunération des actes professionnels, il y a une
colonne à côté qui porte sur les frais de cabinet. Et, par exemple, pour les
ophtalmologistes, autour de 650 000 $, le revenu moyen annuel par les
actes qu'ils posent, les actes médicaux, et, dans ce montant-là, il y a un
montant de 85 000 $ à 90 000 $ qui couvre les frais de
cabinet. Donc, il y a eu une dérive qui a fait que, dans les 10 dernières
années, certains médecins ont commencé à charger des frais qui, normalement,
étaient inclus dans leurs actes professionnels. Alors, ça doit se régler de
cette façon-là.
Pourquoi on dépose un projet de loi? Parce
que le ministre, actuellement, même s'il a dit qu'il était prêt à abolir les
frais accessoires, il n'a pas posé les gestes qui permettent aux citoyens
d'être protégés et il n'a pas posé les gestes qui permettent, qui font en sorte
que les patients, actuellement, les Québécoises, les Québécois ne se font plus
facturer ces frais-là.
D'abord, il avait convenu que c'était le
statu quo, c'est-à-dire que, donc, les médecins pouvaient continuer à charger
tant qu'il n'y avait pas l'entrée en vigueur de son règlement. Donc, en disant :
Je ne ferai pas entrer en vigueur le règlement sur les frais accessoires, il
maintient la situation actuelle, qui doit arrêter, qui doit arrêter. Depuis
10 ans, ça doit arrêter, cette situation-là. Ça n'aurait jamais dû
s'instaurer, et ça doit définitivement cesser.
Deuxième élément, le ministre dit qu'il va
permettre certains frais. Alors, il y a des frais administratifs qu'il veut
autoriser, on n'est pas contre. Par exemple, quand un médecin remplit un
formulaire pour permettre à quelqu'un de renouveler son permis de conduire, ça,
ça s'appelle des frais administratifs, et ce ne sont pas des frais assurés.
Alors, moi, le projet de loi que je dépose
aujourd'hui avec le Parti québécois, c'est un projet de loi qui vise à
interdire la facturation des frais accessoires pour des services assurés. Et
donc, dans ce contexte des services assurés, son excuse qu'il a donnée à la
période de questions ne tient pas la route. Alors, les services assurés, ce
sont des services médicaux. Quand on va voir un ophtalmologiste, un
dermatologue, quand on va voir un spécialiste, ça ne devrait pas nous coûter
quelque chose. Ça fait partie de la Loi sur l'assurance maladie, et c'est une
loi qui interdit ce genre de frais.
Mme Fletcher
(Raquel) : It is already illegal to have user
fees in Canada, federally speaking. Why, then, do we
need to bring in this new legislation to prohibit that in Québec?
Mme Lamarre : In fact, it's illegal, but there are some few exceptions. For
example, if a medication is needed while the patient is in the office of the
physician, if, for example the physician needs an «anesthesian», something to
control pain before doing some small surgery in his office, it was allowed. But
because there has been so much, you know, «dérives», because there has been so
much exaggeration, there is no way to control that for now. And those fees were
supposed to be very, very rare and very... at low cost, you know, a few dollars.
In fact, during the last 10 years, we saw a lot of increasing of these
fees and the patients don't have the choice to pay. When they are in the
physician's office and the physician said : It will cost you $100, they
had to pay. So, that is illegal and we don't want it… we want it clearly. So,
to be sure that it will be clear, our bill asks to remove completely any reimbursement,
any possibility for a physician to charge anything to his patients. It must be
included in the envelope of the remuneration, of physicians' remuneration. It
will be easier to control and, for the patient, at least it will be a guaranty
of justice, of equity. Otherwise, for now, many patients don't have the $50
that is asked to them when they have to see a physician and so some patients
don't ask for essential needs, essential cares that they need.
Mme Fletcher (Raquel) :And you are saying this should have been
done 10 years ago?
Mme Lamarre : Yes, that should have been done. You know, it should happen right
now, otherwise what? You know, the Minister… the bill was adopted in November.
It's six months ago, now. So, for now, if we were expecting the rules, in fact
we would like not having any rules about that, but we would at least know what
will happen, and the Minister didn't publish the rules, and recently he said he
won't allow that. But, keeping it at the status quo, he is encouraging
physicians to continue to charge as they used to charge during the last
10 years. And what he argued as an argument to implement his rules, still
keeping rules as he… is concerning administrative fees, and, for administrative
fees, as I said, for filling a formulary, he doesn't have to go through a law,
he just has to ask to federations of physicians to make something clear and to
make it available that patients can see how much it will cost them if they want
to fulfill something for their driving car permit, that's enough, but, for all
the insured services… and that's the difference, and we don't have to mix it as
the Minister would like to. So, my bill is concerning insured services, insured
medical services. So, for all of these, there is no reason, now, to continue to
charge anything to any patient in Québec. So, that's clear and that may be effective very shortly.
Mme Fletcher (Raquel) : OK. On the petition that you released in the House on the… «le
Commissaire à la santé», you had a petition. Why is it important for you… The Health Minister says that INESSS will be just as independent as «le commissaire».
So, with is it important to you
to keep that body as well?
Mme Lamarre : «Le commissaire» is, I would say, the last bodyguard that we have
for our health system in Québec.
Mr. Barrette removed all
the other organizations that were responsible of giving advice, of giving us
studies to appreciate the performance of our health system. He removed all of
them. And «Commissaire à la santé» is not, you know, expensive. Even people who
work for them will still work, so they will have to be payed. But he was
independent, and this is the difference. They were completely independent and
their subject of studies… They are the only ones who work on these kinds of
subjects because they have a kind transversal analysis of the performance of
our health system. I give you some examples : How does it work in «CHSLD»?
What is the impact of emergency? What about «fécondation in vitro»? What about
remuneration of physicians? So, those, neither INESSS neither INSPQ has these
objectives, these missions in their own mission.
Mme Fletcher (Raquel) : And how many people signed your petition?
Mme Lamarre : Sorry?
Mme Fletcher (Raquel) : How many people signed the petition?
Mme Lamarre : More than 6,000 people and, in fact, it's very interesting
because, you know, it may be seen as a kind of philosophy to ask for the «commissaire»
still going, still being there as a gate people. And that some people from
different sectors recognize the importance, the essential character and
contribution of the «commissaire» and his works and his team indicates that
there is enough of the Minister doing everything only
with his own perception, with his own decision. And, if he's so proud of what he introduced as a reform, he must be happy that someone
independent will give advice and will tell how good are his reforms. So, by
changing the mission of this... of the «commissaire», by decreasing his
independence, he is making our health system under no objective evaluation.
